The Shire's Local Laws

In accordance with the Local Government Act 1995, local governments have legislative power to make local laws where prescribed, or necessary, for the good governance of the local district.

  Please note, clause 3.10(b) (removal of refrigerants from disused refrigerators or similar) will not be enforced by the Shire, as the Commonwealth now regulates this field through a licensing system. The Shire is undertaking to amend the Shire of Donnybrook-Balingup Animals, Environment and Nuisance Local Law 2017 in compliance with legislative requirements to reflect this.

  Please note, the Shire is undertaking to amend the Shire of Donnybrook-Balingup Waste Local Law 2017 in compliance with legislative requirements to include an 'Objection and Appeal Rights' Clause, and redraft Clause 2.1.

Repealed

The following local laws, or sections of local laws, have been repealed within the last 7 years:

• Health Local Law (1999), Section 4.2 (disposal of refuse) is now covered by the Waste Local Law 2017 (see above).
• Removal of Refuse, Rubbish and Disused Materials Local Law (2001)
  This is now covered by the Animals, Environment and Nuisance Local Law (2017).
• Miscellaneous Provisions Local Law
  This is now covered by the Animals, Environment and Nuisance Local Law (2017).
• Standing Orders
  This has been replaced by the Meeting Procedures Local Law (2017).
